This Policy applies to personal information we collect through the Services, including when you contact us, request services, create an account (if applicable), make payments, or submit content for processing.

Depending on the engagement, PovesAI may act as:

a data controller for account, billing, marketing, and website administration data; and/or

a data processor/service provider when processing Customer Content on behalf of a business client.

We collect the following categories of information:

Contact and account information. For example, name, email address, phone number, company name, role/title, and any information you submit through forms or communications.

Customer Content (AI inputs and conversations). The information you or your users submit when using the Services, such as prompts, instructions, messages, conversation text, and related content, as well as the AI-generated outputs. This is sometimes referred to as “user inputs” and “conversations.”

Payment and billing information. We may collect billing contact details and transaction-related information needed to provide the Services. We do not store full payment card details; card data is handled by a third-party payment processor on its systems.

Support communications. Information you provide when you contact us for customer support, troubleshooting, or inquiries.

Technical data. Information such as IP address, device and browser type, logs, timestamps, and approximate location derived from IP address, used for security and service operations.

Cookies and similar technologies. We may use cookies or similar tools that are necessary for site functionality and to support communications or service delivery. If we enable analytics or marketing cookies in the future, we will provide appropriate notice and choices where required.

4. How We Use Your Information

To provide and operate the Services. Including delivering AI services, processing Customer Content, managing accounts, and generating outputs.

To improve models and service quality. You indicated that some user inputs and conversations are used for improving AI. Where applicable, we may use Customer Content to evaluate and improve our workflows, prompts, and service performance, and to maintain quality and reliability.

To provide customer support. Including responding to requests, fixing issues, and communicating about service status.

For marketing. To send marketing communications and offers where permitted. You can opt out at any time.

For compliance and protection. To comply with legal obligations, enforce agreements, prevent abuse or fraud, and protect the rights, safety, and security of PovesAI and others.

5. AI-Specific Processing

Because we provide AI services, the following applies:

Use of third-party AI providers. We use third-party AI technology providers (including OpenAI) to process prompts and generate outputs as part of delivering the Services.

Training and improvement. If Customer Content is used for “improving models,” it may be used to improve our service and AI workflows (for example, quality evaluation, debugging, prompt refinement, and performance improvement). We aim to limit use to what is necessary for these purposes and to apply reasonable safeguards.

No automated decisions with legal or similarly significant effects. Our Services are not intended to be used for automated decision-making that produces legal or similarly significant effects on individuals. If you use the Services for high-stakes decisions, you are responsible for ensuring appropriate human review and compliance.

AI output notice. AI outputs can be inaccurate, incomplete, or inappropriate for specific use-cases. You are responsible for verifying outputs before relying on them.

6. Third Parties We Use

We share information with trusted third parties only as needed to operate the Services, including:

GoHighLevel (CRM and customer management), OpenAI (AI processing), and Twilio (communications such as messaging and related delivery).

We may also use payment processors and other operational vendors from time to time. These third parties process personal information under their own terms and/or on our instructions to provide the Services.

7. How We Share Information

We may disclose personal information in the following situations:

Service providers and vendors. To companies that help us run the Services (such as those listed above).

Legal and safety reasons. If required by law or legal process, or to protect rights, safety, and security, investigate fraud, or enforce agreements.

Business changes. If PovesAI is involved in a business transaction (such as a sale of assets), information may be transferred as part of that transaction.

No sale of personal information. We do not sell personal information for money. If, in the future, we engage in practices that qualify as “selling” or “sharing” under certain US state laws (for example, cross-context behavioral advertising), we will provide appropriate notices and opt-out mechanisms.

8. International Data Transfers

PovesAI operates from Argentina and serves customers worldwide. Your information may be processed in countries other than your own, including where our vendors operate (for example, the United States).

If the GDPR applies and we transfer personal data to countries without an adequacy decision, we may rely on recognized safeguards such as the European Commission’s Standard Contractual Clauses (SCCs).

9. Data Retention

We retain personal information until you delete your account, and as otherwise necessary to provide the Services. After account deletion, we will delete or anonymize personal information within a reasonable period, unless we must retain certain information for legal compliance, resolving disputes, enforcing agreements, or security purposes.

Because systems may use logs and backups, residual copies may persist temporarily and be removed through normal backup rotation.

We use reasonable technical and organizational safeguards designed to protect personal information, including encryption in transit and other standard protections appropriate to the nature of the data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
